NOTE PER THE USMS:

A Consent Final Order of Forfeiture issued on November 19th, 2015 by the United States District Court for the Eastern District of Virginia has passed clear title to N570R to the United States.  The Consent Final Order of Forfeiture of November 19th, 2015 references that notice of the forfeiture was provided to all those described in exhibit A to the Motion for Entry of a Consent Final Order of Forfeiture, which motion was filed November 19th, 2015 in Eastern District of Virginia case number 2:14-cr-25.  Among those noticed were David and Wendy Steiner and CritelliJets, Inc..  All those to whom notice was provided had an opportunity to file a petition to have their interest or lien recognized.  CritelliJets, Inc. did not file a petition.  The Steiners did file a petition and their petition was addressed in the Consent Final Order of Forfeiture of November 19th, 2015.  21 U.S.C. § 853(n)(7) provides that “[f]ollwing the court’s disposition of all petitions filed under this subsection…the United States shall have clear title to property that is the subject of the order of forfeiture and may warrant good title to any subsequent purchaser or transferee.”  In accordance with 21 U.S.C. § 853(n)(7), the Consent Final Order of Forfeiture of November 19th, 2015 provides that “[a]ll right, title, and interest in the forfeited property vests in the United States as of the date of this Order.”  The Consent Final Order of Forfeiture of November 19th, 2015 has been sent to the Federal Aviation Administration.  Pursuant to the Consent Final Order of Forfeiture, clear, lien-free title will be transferred to the new owner of the aircraft.
